Helpdesk Service for E.LIM.E.E Members

The Hellenic Ports Association (E.LIM.E.E), within the framework of its mission to support the smooth operation and institutional compliance of port organizations, offers its members the service Helpdesk, which functions as a central point of direct communication and support. Through it, members have the opportunity to receive timely answers and guidance on issues concerning the implementation of the current institutional framework, the interpretation of laws, ministerial decisions and circulars, as well as practical assistance on issues of administrative management, concessions, licensing, port fees and land zone management. At the same time, the Helpdesk provides best practices, suggestions for the organization of operational procedures and clarifications on daily or complex operational questions, contributing to the uniformity, efficiency and transparency of the operations of all E.LIM.E.E member ports. The service is planned to be further upgraded in the near future, with the integration of capabilities Artificial Intelligence (AI), in order to further facilitate the search for information and direct service to members.

This service supports E.LIM.E.E member ports in matters of administrative management, implementation of the institutional framework and organization of operational procedures.

 

Object and Purpose of the Service

The Helpdesk operates as a point of direct support and facilitation for E.LIM.E.E members, providing:

  • Interpretative guidance for the implementation of laws, ministerial decisions and circulars.
  • Support on issues of port fees, concessions, licensing and land zones.
  • Best practices.
  • Clarifications to questions regarding administrative and operational procedures.
  • Concentration of common issues among members and formulation of unified positions.
  • AI capabilities will be added to the Helpdesk's evolution to better facilitate users.

1. ISPS RETURNABLE FEE In the event of a cruise ship arriving within the port's berth, is there an obligation to pay ISPS passenger surcharges: A) for passengers who remain on board while some disembark? B) when no passengers disembark? Based on decision 3113.11/37616/2024 (Government Gazette 3264 B/10.06.2024) ''The passenger fees of I/C ships, which fall within the scope of Regulation 725/2004 EC and/or the ISPS Code and perform international cruises, are set at 2,5 euros/passenger.'' Consequently, the fee concerns all passengers regardless of disembarkation.
2. VESSEL REGISTRATION BY AN EXTERNAL PARTNER Is the cooperation of the D.L.T. or L.T. with an external partner for the registration of vessels permitted? Yes. This possibility is provided for in article 90 of Law 4504/2017, as amended by article 24 of Law 4551/2018.
3. ISSUANCE OF LICENSES FOR THE OPERATION OF A SHOP OF HEALTH INTEREST (KYE). WITHIN THE LAND ZONE OF THE PORT Does the procedure through OpenBusiness apply to Municipal Port Funds or does Joint Ministerial Decree F.3131/17/96/1997 apply? The Municipal Port Funds have not been integrated into the OpenBusiness platform. Consequently, the process is still governed by the aforementioned Joint Ministerial Decree (Government Gazette 178/B/1997).
4. DOORSTEP FEES FOR SPORTS VESSELS Is there an exemption from fees for nautical sports boats? Yes, only for the duration of the competitions. Boats participating in nautical competitions are exempt from mooring, mooring and stern mooring fees only during the competitions.
5. PARABLE TO DANA Is there a mooring fee in case of mooring alongside (dana)? The current legislation does not provide for a fee for mooring in a mooring. The charge can be based on JMD 812231/29/2014 (Government Gazette 2032 B/25-07-2014). The responsibility for safe mooring belongs to the Management Body.
6. FINANCIAL SUPPORT FOR PORT STAFF Can a food allowance also be granted to personnel serving at the Port Authority, who have a residence with full ownership or usufruct on the island? According to Law 4483/2017, food and housing benefits do not apply to those who have full ownership or usufruct in the service area. However, the final decision lies with the Board of Directors, which may approve the payment of a food allowance to all personnel, clearly defining the benefits and their duration.
7. TOURIST PROFESSIONAL BOATS Are commercial tourist vessels with a charter agreement required to pay an MTN fee? No, tourist commercial vessels are not subject to payment of a fee to the MTN due to the existence of a charter agreement.
8. CALCULATION OF PORT DUTIES What is the correct procedure for calculating port fees per day? According to Joint Ministerial Decision 3113.11/48682/21 (Government Gazette B' 2032/2021) and Government Gazette 3013/8.7.2021, the fees are calculated per day as follows: Small boats (0–7 m.): Length × days × €0,80 Professional day boats (regardless of length): Length × days × €0,08 Professional pleasure boats (7,01 m. and above): Length × days × €0,20 Private pleasure boats: 7,01–10 m.: Length × days × €0,41 10,01–15 m.: Length × days × €0,47 15,01 m. and above: Length × days × €0,55 Traditional ships: Length × days × €0,08 Advance fee discounts: 1 month: 20% discount 6 months: 30% discount 12 months: 40% discount
9. CONCESSION OF NEW OIL Is a tender procedure required for the re-concession of a tugboat whose previous concession has expired? Concessions for the use of space in the Port Land Zone may be carried out with or without a competitive procedure depending on the type of concession, the duration and the purpose of use. The concession of a tugboat requires a competitive procedure.
10. INSPECTIONS IN STORES OF HEALTH INTEREST (SHE) Is the same Body responsible for compliance with the concession conditions in the Land Port Zones? Does it also apply to the non-fenced Zones? Yes. According to articles 19–21 of Law 5092/2024 (Government Gazette 33 A/4.3.2024): • Fenced Zones: The Agency must check the operating permit, compliance with simple use limits and the existence of unauthorized works. • Unfenced Zones: The control is limited to the use of the space and any illegal interventions. In cases of violations, the Agency and the Port Authorities shall inform the Land Service and, if necessary, the Prosecutor. Mixed control teams may be formed in cooperation with the police authorities.
11. REDUCTION OF PORT DUTIES From 1/5/2025, the fee reduction for private boats, day boats and fishing boats is in effect. The reduction in port fees applies to Ports that have coastal shipping (passenger ships).
12. DIGITAL TRANSACTION FEE In cases of unilateral concessions, who pays the digital transaction fee – the DLT or the store owner? According to Law 5135/2024 (Government Gazette 147 A/16.09.2024), the obligation to pay the digital transaction fee falls on the body that issues the concession, namely the Municipal Port Fund. The store owner is charged with the fee through the transaction.
